The Modernization of Cosmetics Regulation Act of 2022 (MoCRA) defines a &#8220;cosmetic product&#8221; specifically as <em>&#8220;a preparation of cosmetic ingredients with a qualitatively and quantitatively set composition&#8221;<\/em> (FD&amp;C Act \u00a7361).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A makeup brush is a <strong>tool<\/strong> that applies cosmetics. It contains no formulation, no ingredient list, no preparation. So:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>No FDA facility registration<\/li>\n\n\n\n<li>No MoCRA cosmetic product listing<\/li>\n\n\n\n<li>No FDA Establishment Identifier (FEI)<\/li>\n\n\n\n<li>No U.S. Agent designation<\/li>\n\n\n\n<li>No safety substantiation file<\/li>\n\n\n\n<li>No adverse event reporting<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">You can confirm this directly: FDA&#8217;s official cosmetic product category list (Appendix A of the <a href=\"https:\/\/www.fda.gov\/cosmetics\/registration-listing-cosmetic-product-facilities-and-products\/cosmetic-product-categories-and-codes\">Registration and Listing Guidance, Dec 2024<\/a>) lists baby products, bath products, eye makeup, hair preparations, and so on. <strong>Brushes are not on the list.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">When Your &#8220;Brush&#8221; Becomes a Cosmetic (the gray zones)<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Three configurations <em>do<\/em> trigger MoCRA. Pre-loaded brushes.<\/strong> A foundation pen, a brush-tip lip gloss, a refillable powder brush sold filled \u2014 these are finished cosmetic products. The brush is just packaging.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2. Brush + cosmetic sold as one SKU.<\/strong> Gift sets that include a lipstick or foundation alongside brushes. The cosmetics inside need listing; the brushes still don&#8217;t.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3. Brushes that make drug or therapeutic claims.<\/strong> &#8220;Antibacterial bristles,&#8221; &#8220;anti-aging brush,&#8221; &#8220;kills 99.9% of bacteria,&#8221; &#8220;treats acne&#8221; \u2014 these claims can reclassify your product as a drug or medical device under FDA, with a vastly heavier compliance load. Keep brush marketing focused on application, design, and softness. Save the science claims for products that can support them.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Actually Does Apply When Importing Plain Brushes<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is the part most &#8220;FDA articles&#8221; miss. A bare brush is not regulated by FDA, but it is not unregulated. Here is the real list:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">CPSC \u2014 Consumer Product Safety Commission<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A makeup brush is a consumer product. That means general safety obligations (no sharp edges, no choking hazards on small components) and the duty to report defects under Section 15(b) of the Consumer Product Safety Act. For brushes, the usual suspects are <strong>lead<\/strong> (in painted handles or plated ferrules), <strong>cadmium<\/strong>, <strong>phthalates<\/strong> (in plastic parts), and sometimes <strong>formaldehyde<\/strong> (in adhesives or fiber finishes). Test your components, and add the on-product warning label if safe-harbor levels cannot be guaranteed. The ones that matter for brushes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>&#8220;Vegan&#8221;<\/strong> \u2014 must be supported (no animal hair, no animal-derived adhesives)<\/li>\n\n\n\n<li><strong>&#8220;Cruelty-free&#8221;<\/strong> \u2014 no animal testing anywhere in the supply chain<\/li>\n\n\n\n<li><strong>&#8220;Eco-friendly&#8221; \/ &#8220;biodegradable&#8221; \/ &#8220;sustainable&#8221;<\/strong> \u2014 must comply with the FTC Green Guides (16 CFR Part 260)<\/li>\n\n\n\n<li><strong>&#8220;Made in USA&#8221;<\/strong> \u2014 strict; &#8220;all or virtually all&#8221; U.S. content required<\/li>\n\n\n\n<li><strong>&#8220;Hypoallergenic&#8221;<\/strong> \u2014 has no specific medical meaning; use only if substantiated<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">CBP \u2014 customs and tariffs<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Bare brushes typically classify under <strong>HTSUS 9603.30<\/strong> (&#8220;brushes for the application of cosmetics&#8221;). For China-origin brushes in 2026, the duty stack includes the base MFN rate, <strong>Section 301 tariffs<\/strong> (commonly 7.5% on List 4A), and additional IEEPA-based duties. Rates have been moving \u2014 check the current schedule at <a href=\"https:\/\/hts.usitc.gov\">hts.usitc.gov<\/a> or with your licensed customs broker before each season&#8217;s PO.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Country-of-origin marking<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Every imported brush must be marked &#8220;Made in China&#8221; (or wherever it was made) in English, in a conspicuous place, legibly and permanently. Mark the <strong>brush handle itself<\/strong>, not just the carton. Standard methods are laser engraving, pad printing, or hot stamp.
